Terms of Service

1. Introduction

This website and online store are operated by World Beverage Company Pty Ltd (ABN 4766 2119 913). "We", "us" and "our" refer to World Beverage Co Pty Ltd. By using our site or making a purchase, you agree to these Terms of Service.

2. Age Restriction & Responsible Supply

You must be 18+ to purchase alcohol from us. By ordering, you confirm you meet this legal requirement. Proof of age may be required on delivery, and our carrier may refuse to hand over your order if age cannot be verified. Supplying alcohol to a person under 18 is an offence. We support the responsible service of alcohol and comply with applicable state and territory liquor laws.

3. Custom & Personalised Orders

Many of our products are personalised to your specifications. Because these items are made to order and unique to you, the following applies:

3.1 Accuracy of your details. You are responsible for the accuracy of all personalisation details you provide, including names, dates, spelling, grammar, punctuation, wording and any design elements. We print your item with the exact text you enter on the website — character for character — and do not amend, correct or interpret what you submit. Please carefully review and double-check everything before placing your order. Once production is complete, errors in the text you provided (including spelling or grammatical mistakes) cannot be corrected, and no refund or replacement is available for those errors.

3.2 Proof approval. Where we provide a digital proof for your approval, production will not begin until you confirm the proof. By approving a proof, you accept the layout, wording and spelling shown. We are not responsible for errors present in an approved proof.

3.3 Production and dispatch times. Personalised items require additional time to produce. Estimated production and dispatch timeframes are shown at checkout or on the product page. These are estimates and may vary during busy periods.

3.4 Variation. As each item is individually produced, minor variations in finish, placement, colour and materials are normal and are not considered defects.

4. Australian Consumer Law (ACL)

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. For a major failure, you are entitled to a replacement or refund and compensation for any reasonably foreseeable loss or damage. If the failure is not major, you are entitled to have the goods repaired or replaced. Nothing in these Terms excludes, restricts, or modifies your rights under the ACL.

5. Orders & Payment

Orders are accepted when we send an order confirmation. We may reject or cancel orders on reasonable grounds (e.g. suspected fraud, pricing error, delivery restrictions, or where personalisation details are unlawful or infringe another person's rights). Payment is required before dispatch.

6. Pricing & Availability

Prices are in AUD and include GST unless stated otherwise. Prices and availability may change without notice.

7. Shipping

We deliver Australia-wide using reputable carriers. Delivery timeframes are estimates and may vary. Alcohol deliveries require age verification and, in some states, may only be handed to the addressee. Risk passes on delivery to your nominated address (see our Shipping Policy for details, including authority-to-leave and ID requirements for alcohol).

8. Returns & Refunds

We comply with the ACL. Because personalised items are made to your specifications, we are unable to offer change-of-mind returns or refunds on personalised products. This does not affect your rights under the Australian Consumer Law where an item is faulty, damaged, not as described, or otherwise fails a consumer guarantee. 9. Acceptable Use

You must not use the site for unlawful purposes; infringe intellectual property; upload malware; attempt to gain unauthorised access; or interfere with the security or operation of the site.

10. Intellectual Property

10.1 Ownership. All content on the site including text, graphics, logos, trademarks, product images, videos and code is owned by us or our licensors and is protected by Australian and international IP laws.

10.2 Your limited licence. We grant you a non-exclusive, revocable, non-transferable licence to access and use the site for personal, non-commercial purposes. You must not copy, reproduce, distribute, adapt, reverse engineer, mine, scrape, or create derivative works from any part of the site except as permitted by law or with our prior written consent.

10.3 Trademarks. Our name, logos and trade dress are our trademarks. You must not use them without our written permission.

10.4 Personalisation content. When you submit names, wording, images or designs for personalisation, you warrant that you own or have permission to use that content and that it does not infringe any third party's rights or any law. We may decline any personalisation request at our discretion.

11. User Content & Reviews

11.1 Your responsibility. If you submit content (e.g. reviews, photos, comments), you warrant it is accurate, lawful, not misleading or defamatory, and that you own or have permission to use it.

11.2 Licence you give us. You grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, edit, publish and communicate your submitted content in connection with our business (including on our site, emails and social channels).

11.3 Moderation. We may remove or decline content that breaches these Terms or applicable laws.

12. Product Information, Responsible Use & Health Advice

12.1 General information only. Product descriptions and content on our site are provided in good faith for general information. They are not medical, nutritional, or health advice.

12.2 Responsible consumption. Consume alcohol responsibly. Do not drink and drive. If you are pregnant, planning pregnancy, or breastfeeding, follow relevant health guidance regarding alcohol consumption. If you have health conditions or take medication, seek professional advice before consuming alcohol.

12.3 Allergens & ingredients. Where provided by manufacturers or required by law, we display mandatory statements and labels. If you have specific dietary or allergen concerns, check the product label and contact us before purchase.

12.4 Third-party links/content. Any third-party information or links are provided for convenience and may change without notice. We are not responsible for third-party content or websites.

13. Limitation of Liability

13.1 No exclusion of ACL rights. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the ACL or any other law that cannot be excluded.

13.2 Extent permitted by law. To the extent permitted by law (and subject to the ACL), we exclude all warranties, representations and conditions not expressly set out in these Terms.

13.3 Loss types. To the extent permitted by law, we are not liable for any indirect or consequential loss, loss of profits, loss of revenue, or loss of data arising from your use of the site or products, except where such loss is required to be covered by law.

13.4 Cap for non-ACL claims. Where our liability cannot be excluded but may be limited, and where the claim is not under the ACL, our liability to you is limited, at our option, to re-supply of services, replacement of goods, or the cost of doing so.

14. Indemnity

You agree to indemnify us (and our officers, employees and agents) against losses, costs, liabilities and expenses to the extent they are caused by:

a) your breach of these Terms; b) your unlawful use of the site or products; or c) your infringement of third-party rights in content you submit for personalisation or otherwise,

except to the extent caused by our negligence, wilful misconduct, or breach of law.

16. Changes to the Site/Terms

We may update the site or these Terms from time to time. The current version applies when you use the site. If a change materially affects your order after acceptance, we will contact you.
